Personal Injury Lawyers Representing Injury Victims in Empire, NV
Empire, Nevada’s story begins less than 100 years ago when in 1923 a small tent city was erected by enthusiastic miners. US Gypsum caught wind of the prosperity in the area and fully owned the town in 1948, including not only the land but the homes and many other structures as well.
From that time the area enjoyed a bit of a boom in population, rising from a handful of individuals to more than 750 throughout the 1960s, all of whom worked for the United States Gypsum Corporation (also known as “USG”).
The recession of the early 21st century hit the community of Empire hard with the gypsum plant eventually needing to close its doors at the end of January 2011. Residents with children at home were allowed to inhabit the homes provided to them through the company until the end of the school year in June, after which time a mass exodus ensued, resulting in there now being only 200 or so inhabitants remaining.
A Ghost Town Welcoming Numerous Visitors
Since the closing of the USG mining operations in Empire, the community has continued to thrive mostly because of the nearby week-long festival Burning Man that has been celebrated each and every year since 1991. During this festival a number of the over 50,000 participants frequent Empire for fuel and other amenities, accounting for as much of 20% of sales in the area. Black Rock Desert and hunters also bring in a share of outdoor enthusiasts to Empire which helps support the local economy.
Taking Action Against Out-Of-State Defendants
Most visitors and tourists are responsible and respectful, but accidents can occur and incidents may arise which can involve out-of-state individuals. This can complicate the legal process if you hope to pursue a settlement for a personal injury or wish to take them to court.
For the most part, suing someone in another state will require you to sue that individual in the state where he or she resides and not within the state you live (you can file the papers through the mail but will need to be present in their state on the day of court).
Fortunately, there are exceptions to every rule:
- A non-resident of your state involved in a vehicular accident can be sued in the small claims court of your state regardless of where the defendant resides
- A non-resident is physically served court papers while within your state’s borders
- Out-of-state owners of real property located within your state can be sued on claims that relate to that property
That being said, the process of suing someone out-of-state can be cumbersome and complicated, and often requires the expertise of a legal professional. At the law office of Bertoldo Carter Smith & Cullen, we have helped a number of clients successfully settle and receive compensation for personal injury and car accident injuries in Las Vegas that came as a result of out-of-state individuals.
