- Those benefits cannot exceed a maximum amount set by law each year, which is currently listed at the maximum benefit of $3,697.04 per month
Temporary total benefits are paid until the injured party reaches their maximum physical improvement or until they can return to their normal job
Temporary Partial Disability Benefits
When workers can work but are earning significantly less than usual due to their injury, they may be eligible for Temporary partial disability benefits.
Temporary partial disability benefits are:
- The difference between your post-injury wages and what would be your temporary total disability rate
There is a 24-month cap on TPD benefits.
Permanent Partial Disability Benefits
Once temporary total disability benefits end, the injured party may be eligible for permanent partial disability benefits.
Permanent partial disability benefits are based on:
- Permanent impairment ratings, which is stated as a percentage
- For each percent of impairment, the injured person will receive 0.6% of their average monthly wage
Permanent partial benefits continue for five years or until the worker reaches the age of 70, whichever happens later.
Permanent Total Disability Benefits
Workers who are totally or permanently disabled may be eligible for permanent total disability benefits.
Permanent total disability benefits are:
- Monthly payments at your temporary total rate for as long as the disability continues
Common permanent total disabilities are often very severe, which can include:
- Paralysis
- Traumatic brain injuries
- Loss of limbs
